Digital Millennium Copyright Act Policy

Welcome to (the ‘Site’). We value the intellectual property rights of others just as we expect others to respect our rights. In accordance with the Digital Millennium Copyright Act, Title 17, United States Code, Section 512(c), a copyright owner or their representative can send us a takedown notice through our DMCA Agent. As an internet service provider, we can claim immunity from infringement claims under the DMCA’s “safe harbor” provisions. To make a good faith infringement claim, the notice should include the following information:

Notice of Infringement – Claim

  1. A signature of the copyright owner or authorized representative;
  2. Identification of the copyrighted work that has been infringed;
  3. Details of the infringing material and a way for us to locate it;
  4. Contact information of the complaining party;
  5. A statement that the use of the material is unauthorized;
  6. A statement that the information provided is accurate and the complaining party is authorized by the copyright owner.

Section 17 USC §512(f) outlines penalties for knowingly misrepresenting information in a notification of infringement.

Keep in mind that we may share the identity of the complaining party with the alleged infringer in copyright infringement claims.

Counter Notification – Restoration of Material

If you receive a takedown notice for copyright infringement, you can submit a counter notification to have the material restored to the site. The notification must meet the following criteria outlined in 17 USC Section 512(g)(3).

  1. Your signature;
  2. A description of the material taken down and its original location;
  3. A statement that the material was removed due to mistake or misidentification;
  4. Your name, address, and consent to jurisdiction for legal matters.

Repeat Infringer Policy

We have a strict policy against copyright infringement and monitor repeat offenders. Accounts of repeat infringers will be terminated.
